DOJ Issues Criminal Subpoenas After District Judge CA Ballot Decision

The federal judge ruled against the Justice Department’s request to sequester ballots from likely noncitizens.

The Department of Justice has reportedly issued federal grand jury subpoenas to California and Los Angeles County election officials related to their roles in allowing noncitizens to illegally vote in elections. The action came after District Judge David Carter ruled against the administration’s emergency motion to require California election officials to sequester ballots from those who appear to be “likely noncitizens” based on the state’s voter rolls.

Judge Carter stated in his ruling, “There is a clear remedy available. The United States can prosecute individuals according to Section 611, as it has historically and recently done. California also has established procedures to cancel the voter registrations of any individuals proven ineligible.”

A Justice Department spokesperson said, “To be clear, the district court judge explained that voting unlawfully results in criminal exposure. Consistent with this, California also wrote in its filing that the remedy for unlawful voting is through criminal prosecution. Thus, while DOJ maintains that a civil remedy is still available, all agree that noncitizen voting is properly addressed through criminal law.”

As the Lord Leads, Pray with Us…

  • For federal judges to be discerning regarding federal and state election laws
  • For Justice Department officials as they seek to ensure state and local election officials uphold the law.
  • For Attorney General Blanche to be led by the Lord as he heads the department’s efforts to protect election integrity.
